Terms and Conditions

GM Outdoor Living: Terms and Conditions


All prices are listed in Australian Dollars (AUD) and include GST where applicable. These Terms and Conditions (“Terms”) form the entire agreement between you (“the Customer”) and GM Outdoor Living. By placing an order or paying a deposit, you acknowledge and accept these Terms. No other contractual terms apply unless expressly agreed in writing by GM Outdoor Living.

  

1. General

GM Outdoor Living provides these Terms to govern all transactions. When you place an order or make a deposit, you agree to these Terms. We encourage you to review them carefully and contact GM Outdoor Living with any questions before proceeding.

  

2. Payment Options


2.1 Deposits and Balance: GM Outdoor Living requires a minimum 30% deposit upon accepting a quote. The remaining balance is due before dispatch. You have a 2-day cooling-off period after paying the deposit to cancel your order for a full refund. After this period, deposits are non-refundable once GM Outdoor Living confirms your order.


2.2 Payment Methods: GM Outdoor Living accepts secure payments via internet banking, debit cards, and credit cards. We will provide details of accepted methods at checkout.


2.3 Non-Payment: If you fail to make payments on time, GM Outdoor Living may suspend your order or cancel your account. We will notify you in writing before taking such actions.


2.4 Full Payment for Saunas and Spas: GM Outdoor Living requires full payment for saunas and spas before dispatch from the factory. If the balance is not paid within 14 days of our notification, your deposit may be forfeited, and the order canceled. GM Outdoor Living will provide written notice to avoid misunderstandings. If extension is required please communicate immediately. 


  

3. Quotations, Pricing, Custom Orders & Deposits


3.1 Pricing: GM Outdoor Living bases prices on the quotation provided or our standard pricing at the time of your order. All prices include GST and are valid for 7 days unless otherwise stated.


3.2 Custom Orders: Custom orders require a non-refundable 50% deposit due to their bespoke nature. GM Outdoor Living will confirm order details in writing to ensure accuracy.


3.3 Price Changes: If costs change due to factors beyond our control (e.g., supplier price increases), GM Outdoor Living will notify you promptly and discuss options, such as amending or canceling your order with a refund for undelivered goods.

  

4. Delivery


4.1 Delivery Times: Delivery times vary based on product availability and location. GM Outdoor Living estimates delivery within 10–13 weeks from order confirmation due to our bespoke manufacturing process. We will provide estimated timelines when you place your order.


4.2 Curbside Delivery: Due to varying truck sizes and property access, GM Outdoor Living guarantees only curbside delivery. You are responsible for arranging access beyond the curb. We recommend assessing your property’s access points before delivery.


4.3 Delivery Changes: If you request changes to delivery details less than 2 days before the scheduled delivery, you may incur additional costs, which GM Outdoor Living will communicate in advance.


4.4 Unattended Deliveries: If GM Outdoor Living delivers products at your request and they are left unattended, you bear the risk of damage or theft. We recommend being present or arranging a secure delivery location. GM Outdoor Living has no control around delivery times and days as we engage multiple logistics providers to deliver your goods to your address. 


4.5 Delays: GM Outdoor Living strives for timely delivery, but delays may occur due to manufacturing or logistical complexities. We will keep you informed but cannot offer compensation or refunds for production delays.


4.6 Storage: If you fail to comply with these Terms (e.g., refusing delivery), GM Outdoor Living may deliver the goods to a storage facility you nominate, at your expense. We will notify you in advance to avoid unexpected costs.

Customer Protection Tip: Confirm delivery details and property access with GM Outdoor Living in advance. Consider purchasing insurance for high-value items to cover potential damage or loss during transit.

  

5. Privacy Act 1988


GM Outdoor Living complies with the Privacy Act 1988. We will not share your personal information without your consent, except as required by law. For details, please review our Privacy Policy on our website.

  

6. Copyright & Intellectual Property


6.1 All materials on GM Outdoor Living’s website, including images and designs, are protected by copyright and may not be reproduced or modified without our permission.


6.2 Intellectual property rights in our products and designs remain with GM Outdoor Living.

  

7. Competitive Pricing


GM Outdoor Living regularly compares our sauna and spa prices with competitors to ensure fair value. If you find a comparable product at a lower price, contact us, and we may review our pricing where possible.


8. Returns, Installation, Damages, or Loss in Transit


8.1 No Unauthorized Returns: GM Outdoor Living will not accept returns without prior authorization. Contact us to initiate a return or discuss issues.


8.2 Custom Orders: GM Outdoor Living builds saunas and spas to your specifications. We do not accept returns for custom orders, including those shipped directly from overseas factories, except in cases of defects or damage.


8.3 Complaints: Report any issues with your order to GM Outdoor Living within 7 days of delivery. Provide photos and a detailed description to expedite resolution.


8.4 Damaged Goods: If goods are delivered damaged, GM Outdoor Living may issue a credit note or replacement within 7 days of delivery, subject to inspection. Do not use damaged products until we assess the claim.


8.5 Change of Mind:  GM Outdoor Living does not accept returns for saunas or spas due to their custom-made nature. However, returns may be considered at GM Outdoor Living’s sole discretion. In such cases, all shipping costs will be the responsibility of the customer.


8.6 Transit Claims: Report claims for damage or loss during transit to GM Outdoor Living within 7 days of delivery. We will work with you and the carrier to resolve the issue promptly.


8.7 Installation Liability: GM Outdoor Living is not liable for indirect, special, or consequential damages arising from delivery or installation, including damage to structures, driveways, or third-party property unrelated to the purchased goods. We recommend hiring qualified professionals for installation.


8.8 Council Regulations: GM Outdoor Living provides general information about local council regulations (e.g., building consents, fencing requirements) but is not responsible for ensuring compliance. You must verify requirements with your local council. We are not liable for costs related to building alterations, removal, delivery, or labor due to non-compliance.


8.9 Weather Damage: GM Outdoor Living is not responsible for damage caused by weather, including wear and tear, paint discoloration, or leaks due to poor maintenance. Follow our maintenance guidelines to protect your product.


8.10 Sauna Heater Installation: GM Outdoor Living requires all sauna heaters to be installed by a licensed electrician who provides a valid certificate of compliance for your state. We are not liable for issues arising from improper installation.


8.11 Misuse and Maintenance: GM Outdoor Living is not responsible for damage due to misuse, such as overheating, fire caused by the sauna stove, flooding the heater with water or chemicals, or failure to maintain the sauna. Damage from improper storage, excessive sunlight exposure, or water stains from sweat or spillage is not covered. Our products are for personal residential use only; commercial use voids the warranty.

  

9. Termination

9.1 GM Outdoor Living may terminate this agreement if you breach these Terms or if the goods become unavailable from our supplier. If we terminate, GM Outdoor Living will promptly refund any payments for undelivered goods. We will notify you in writing of any termination.

At GM Outdoor Living, we create custom-sized saunas tailored to your exact specifications. Each sauna is built to order, ensuring a perfect fit. Please note, as these are custom creations, returns are not accepted.
