GM Outdoor Living: Terms and Conditions

All prices are listed in Australian Dollars.

1. General

These terms and conditions ("Terms") constitute the entire agreement between you, the customer, and GM Outdoor Living. No other contractual terms apply, and placing an order or making a deposit implies acceptance of these Terms.

2. Payment Options

2.1 A minimum 30% deposit is due upon accepting a quote. The balance is payable before dispatch. Deposits are non-refundable once your order is placed.

2.2 We accept various payment methods, including internet banking, debit/credit cards.

2.3 Failure to pay may result in suspension of supply or account cancellation.

2.4 All saunas and spas must be paid in full before factory dispatch. Failure to pay balance within 14 days will result in loss of deposit. 

3. Quotations, Pricing, Custom Orders & Deposits

3.1 Prices are based on current quotations or standard prices at the order date.

3.2 Custom orders require a non-refundable 50% deposit.

3.3 Prices in quotations exclude taxes and additional charges.

4. Delivery 

4.1 Delivery times vary. We may refuse an order and deliver to a storage location nominated by you if you fail to comply with Terms.

4.2 You are liable for costs if delivery changes are requested less than 2 days before delivery.

4.3 You are liable if product is left unattended and is damaged.

5. Privacy Act 1988

We adhere to the Privacy Act; personal information is not shared without permission.

6. Copyright & Intellectual Property

6.1 Website materials may not be modified or reproduced.

6.2 Intellectual property rights remain with GM Outdoor Living.

7. Similar Elsewhere

We regularly compare our saunas and spa prices with other suppliers.

8. Returns, Installation,  Damages, or Loss in Transit

8.1 Unauthorized returns will not be accepted.

8.2  All saunas are custom-built to your specifications. Returns are not accepted for customised orders, which include any orders coming directly from the overseas factory. 

8.3 Complaints must be submitted within seven (7) days of delivery.

8.4 Credit notes may be issued for damaged goods within (7) days of delivery

8.5 Saunas and Spas cannot be returned due to a change of mind.

8.6 Claims for damage or loss in transit must be made promptly (7 days).

8.7 We are not liable for indirect damages during delivery and installation. GM Outdoor Living does not accept liability for any indirect, special, incidental or consequential damages incurred as a result of delivery & installation of the sauna/ spa pool into position at the destination, including but not limited to damage to structures, driveways & any other third party structures unrelated to the goods purchased. 

8.8 GM Outdoor Living does not accept liability for any indirect, special, incidental or consequential damages incurred as a result of delivery & installation of the sauna or  spa pool into position at the destination, including but not limited to damage to structures, driveways & any other third party structures unrelated to the Goods purchased.

8.9 GM Outdoor does not accept any responsibility or liability for any advice given in connection with local council regulations including but not limited to building consents, resource consents and/or spa and swim spa fencing requirements. Any information provided is general, and is not intended to address your specific circumstances. All enquiries should be directed to and checked with the local council. GM Outdoor Living will not be liable for costs associated with but not limited to building alterations, removal costs, delivery costs, or labour costs associated with the replacement of a sauna/ spa.

8.10  Damage due to weather is not the responsibility of GM Outdoor Living. This includes wear and tear, paint discoloration, or a leaking roof caused by poor maintenance.  

8.11 All sauna heaters must be installed by a qualified electrician who can provide a certificate that is valid for the respective state in accordance with the law. GM Outdoor Living is not responsible for any poor workmanship.

8.12  GM Outdoor Living is not responsible for any misuse of the sauna, including overheating it, burning it down through the sauna stove, or flooding the heater with water or any chemicals. Sauna must be maintained correctly. Warping or damage caused by failure to cover the product when packaged in protective wrap and excessive exposure to sunlight is excluded from this warranty. Damage caused by improper installation is excluded from this warranty. Water damage, stains or swelling of the wood due to sweat or spillage is excluded from this warranty.  This product is intended for personal residential use only, commercial use is not covered by this warranty. 

9.  Termination

9.1 We may terminate this Agreement immediately if, in our reasonable opinion, you breach its terms or if the goods you purchased become temporarily or permanently unavailable from our supplier. In the event of termination, we will refund any payments made for goods that you have not yet received.
